These Terms of Service ("Terms") govern your use of BarkScoop ("we," "us," or "our") pet waste removal services and our website. By requesting a quote, starting a plan, or using our website, you agree to these Terms.
Please read them carefully. If you do not agree, please do not use our services.
1.Our services
BarkScoop provides pet waste removal in the Chicago area and across Illinois, including weekly, twice weekly, and every other week yard scooping on a recurring basis. The specific service, frequency, and yard included are based on the details you provide when you request a quote and start a plan.
2.Quotes and service area
Quotes are based on the information you give us about your property, including number of dogs and access. We provide pet waste removal across the Chicago area and Illinois. If your address falls outside our service area, we will let you know.
Online quotes assume a standard yard of up to about 1/8 acre, so we do not ask for exact yard measurements upfront. We verify yard size after you sign up, and if your yard is larger than our standard scope or the conditions differ materially from what was described, we reserve the right to update your online quote accordingly. We will let you know before any change takes effect.
3.Scheduling and yard access
For recurring plans, we visit on a regular schedule based on the plan you choose, whether that is twice weekly, weekly, every other week, or monthly. To let our team scoop safely and on time, you agree to:
- Provide safe, unobstructed access to the yard on your scheduled day, including gate codes or unlocked gates where needed.
- Let us know if your dog is nervous, protective, or not comfortable around people they do not know, and keep those dogs inside during the cleanup. Most dogs are welcome to stay out while we work. If our team is ever not comfortable working around a dog, we will let you know and ask that they are kept inside from then on.
- Let us know about anything our team should be aware of, such as aggressive animals, hazards, or sensitive landscaping.
If we cannot safely access the yard, or a dog makes it unsafe for us to work, we may skip the cleanup. Cleanups skipped for reasons within your control may still be billed.
Because we run efficient daily routes that cover many yards, we cannot promise a specific arrival time on your service day. Routes generally run during daylight hours, and your service day stays the same each week. We will let you know by text when our team is on the way, and if your regular day ever needs to change, we will tell you in advance.
4.Weather, holidays, and rescheduling
Severe weather, heavy snow, or unsafe conditions may require us to reschedule a cleanup. When that happens, we will make a reasonable effort to complete your service on the next available day or fold the work into your next cleanup. We do not provide refunds for weather related rescheduling.
If your regular service day falls on a major holiday, we may skip that cleanup and catch your yard up on your next scheduled cleanup, clearing the additional buildup at that time. Because recurring plans are billed monthly rather than per cleanup, your monthly charge is not reduced for a holiday week.
5.Billing, recurring charges, and authorization
All recurring plans are billed monthly and in advance, with no long term contract. When you start a recurring plan, you authorize BarkScoop and our third party payment processor to store your payment method and to automatically charge it on a recurring monthly basis for your plan, plus any agreed add ons, applicable taxes, and one time charges, until you cancel in accordance with these Terms. This is a continuing authorization that remains in effect for as long as your plan is active.
For recurring plans, regular monthly billing takes place on the first of each month, in advance of that month's service. Before we begin service we require a valid payment method on file and payment of your initial charge. We calculate that initial charge when you sign up and take it before your first cleanup, and we will tell you the exact amount beforehand. If the details you provided check out and your quote is unchanged, no further approval is needed, and your saved payment method is charged that amount automatically. If your quote needs to change for any reason, we will contact you about the updated amount before your payment method is charged. Depending on when in the month you start, your plan type, and any promotion that applies, your initial charge may be a prorated amount covering the remaining cleanups in the current month, your first full month of service in advance, or a combination of the two. Recurring monthly billing then begins on the first of the month following the last month your initial charge covered, so that no month is billed twice. See section 8 for how a free first cleanup affects this.
We send service on a recurring schedule, so charges continue automatically each billing cycle without a separate reminder. It is your responsibility to keep a valid, current payment method on file.
If a payment is declined or fails, we may retry the charge, pause your service until payment is resolved, and charge a reasonable fee for declined or late payments to the extent permitted by law. You are responsible for any costs we incur in collecting past due amounts. Our payment processor handles your billing details securely, and we do not store full payment card numbers on our own servers.
6.Price changes
Our rates may change over time. For recurring plans, we will email you notice at least 30 days before a new rate takes effect. If you continue service after the effective date, the new rate applies. If you do not agree to a price change, you may cancel as described below. We may also adjust your quote if the actual conditions at your property, such as yard size, number of dogs, or buildup, differ materially from what you described; that adjustment is a correction to your quote rather than a rate change, and takes effect after we notify you as described in section 2.
If the number of dogs at your property changes, please tell us, and we will adjust your plan beginning with your next monthly billing date after you let us know. Adjustments are not applied retroactively, and a month that has already been billed is not refundable or prorated, as described in section 7. Where you tell us promptly, we may apply a credit at our discretion.
7.Cancellation and pausing
There is no contract, and you may cancel at any time by contacting us. Cancellations take effect at the end of your current billing period. Amounts already billed for the current month are non refundable, and you are welcome to keep receiving service through the end of the period you have paid for.
You may also ask us to pause service, for example while you travel, and we will do our best to accommodate. A pause does not refund or reduce a month that has already been billed. You are welcome to keep receiving service for the rest of that month, and your pause takes effect from your next billing date.
More generally, once a month has been billed that amount is non refundable. We do not prorate, refund, credit, or carry forward any part of a billed month in any circumstance, including cancellation, pausing, unused or declined cleanups, cleanups you ask us to skip, and cleanups rescheduled for weather or holidays. Your plan is priced as a monthly service rather than per cleanup.
8.Free first cleanup
From time to time we offer a free first cleanup for new customers who start a recurring plan. The free benefit applies only to the specific service stated in the offer; all other cleanups on your plan are billed at the standard rate, and promotional benefits are limited to what the offer expressly states. This offer applies only to regular recurring plans and may not be combined with other offers. If you cancel before your plan has been active for a reasonable initial period, we may bill for the value of the first cleanup. We reserve the right to modify or end this offer at any time.
Where a free first cleanup applies, it reduces the amount due for your first month. In some situations that leaves nothing further to pay for that month, for example when you start near the end of a month, or when your plan includes a single cleanup per month. In those situations we bill your first full month of service in advance at signup, so that payment is on file before service begins. Your recurring monthly billing then starts on the first of the month after the month your initial payment covered. We will always tell you your initial charge and what it covers before your first cleanup.
9.Information you provide and communications
To set up and run your service, we collect and process the information needed to provide it, including your name, service address, contact details, property and pet details, and payment information. You agree to provide accurate, complete information and to keep it up to date. We handle your information as described in our Privacy Policy.
By giving us your phone number, including when you request a quote on our website, you agree that we may contact you about your service, scheduling, billing, and account, and that we may send you marketing and promotional messages, by phone call, automated text message, and email. Message and data rates may apply, and message frequency varies. You can opt out of non essential messages at any time by replying STOP to a text or contacting us.
10.Your responsibilities
You are responsible for maintaining a reasonably safe environment for our team, including keeping walkways clear and informing us of hazards. You confirm that you own the property or have permission to authorize service on it. We are not responsible for pre existing conditions such as lawn damage, pests, or odors that are not caused by our work.
Your plan price is based on the number of dogs at your property, so please tell us if that number changes, before your next billing date. Your invoice shows the number of dogs we have on file, so you can check it each month. You can reach us at service@barkscoop.com or (224) 490-0449.
11.Right to refuse or discontinue service
We want every cleanup to be safe and pleasant for our team and your pets. We reserve the right to refuse, pause, or discontinue service for any reason, including unsafe conditions, aggressive animals, repeated access problems, or nonpayment.
12.Disclaimers and limitation of liability
We perform our services with reasonable care and skill. To the fullest extent permitted by law, our services are provided "as is," and we disclaim all other warranties. While our team takes care to secure gates after every cleanup, you remain responsible for the security of your pets and property, and we are not liable, under any circumstances or for any reason, for any pet that leaves or escapes the property, including through a gate, fence, or other opening, before, during, or after a cleanup. We are not liable for indirect, incidental, or consequential damages. Where we are found liable, our total liability to you will not exceed the amount you paid us for services in the month giving rise to the claim.
If we miss a spot during a cleanup, please notify us within 24 hours of that cleanup and we will return to re-scoop the missed area at no additional charge. This complimentary re-scoop is your sole and exclusive remedy for any missed waste. Requests made more than 24 hours after a cleanup may instead be addressed during your next scheduled cleanup.
13.Photos and media
We may take photos and video of our work, our crews, and the areas we service, including before and after images, for quality control, record keeping, training, and marketing or promotional purposes. We will not publish your name, street address, or other personal contact details alongside these images without your permission. After a cleanup we may also send a photo of your closed gate by text or email to the contact on file so you have a record that it was secured.
14.Changes to these terms
We may update these Terms from time to time. Continued use of our website or services after a change indicates your acceptance of the updated Terms.
15.Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any disputes will be handled in the state or federal courts located in Illinois.
